This obligation arises from Article 4 of the EU Regulation on Artificial Intelligence (AI Regulation), the so-called AI Act. The regulation affects almost every company that uses AI tools &#8211; from ChatGPT in marketing to automated applicant management systems in HR.  <\/p><p>But what does this training obligation mean in concrete terms? Which companies are affected? And how can the requirement be implemented in a practical and legally compliant manner? This article provides you with a fact-based overview without scaremongering &#8211; with specific recommendations for HR managers and compliance officers.   <\/p><h2>What is the AI Act training obligation under Article 4?<\/h2><p>The EU Regulation on Artificial Intelligence (Regulation (EU) 2024\/1689) has been in force since August 2024. Article 4 of the regulation regulates the so-called <strong>AI competence obligation<\/strong> and obliges providers and operators of AI systems to ensure that &#8220;their personnel and other persons involved in the operation and use of AI systems on their behalf have a sufficient level of AI competence.&#8221; <\/p><h3>What is AI competence?<\/h3><p>According to Article 3 No. 56 of the AI Regulation, AI competence includes<\/p><ul><li><strong>Skills and knowledge<\/strong> to use AI systems competently<\/li><li><strong>Understanding<\/strong> the opportunities and risks of AI<\/li><li><strong>Awareness<\/strong> of potential damage that can be caused by AI<\/li><\/ul><p>The training should take into account the technical knowledge, experience, training and specific operational context of the employees.<\/p><p><strong>Source:<\/strong> <a href=\"https:\/\/eur-lex.europa.eu\/legal-content\/DE\/TXT\/?uri=CELEX:32024R1689\">EU AI Act, Articles 4 and 3(56)<\/a><\/p><h2>Who is affected by the AI training obligation?<\/h2><p>The training obligation has been in force since February 2, 2025 and affects <strong>all companies<\/strong> that use or develop AI systems &#8211; regardless of size or industry.<\/p><h3>Affected are:<\/h3><p><strong>Providers:<\/strong> Companies that develop AI systems and put them into operation or launch them on the market under their own name.<\/p><p><strong>Operators:<\/strong> Organizations that use AI systems on their own responsibility without having developed them themselves.<\/p><h3>Practical examples:<\/h3><ul><li>A company that uses <strong>ChatGPT, Claude or Gemini<\/strong> for customer communication<\/li><li>HR departments that use <strong>CV parsers or matching algorithms<\/strong> in recruiting<\/li><li>Marketing teams that use <strong>AI-powered content tools<\/strong> <\/li><li>Finance departments with <strong>automated risk analyses<\/strong><\/li><\/ul><p><strong>Important:<\/strong> Even the use of common AI tools such as Microsoft Copilot or ChatGPT in an operational context is covered by the regulation.<\/p><p><strong>Sources:<\/strong> <a href=\"https:\/\/www.ihk-muenchen.de\/ratgeber\/digitalisierung\/kuenstliche-intelligenz\/ai-act\/\">IHK Munich on the AI Act<\/a>, <a href=\"https:\/\/www.haufe.de\/personal\/arbeitsrecht\/arbeitgeberpflicht-zur-sicherstellung-der-ki-kompetenz_76_639984.html\">Haufe: Employer obligation AI competence<\/a><\/p><h2>What are the consequences of non-compliance?<\/h2><p>Clarity is important here: <strong>a breach of the training obligation under Article 4 is currently not directly punishable by fines<\/strong>. Article 99 of the AI Regulation, which regulates the sanctions, does not specify any direct penalties for non-compliance with the training obligation.<\/p><h3>What threatens instead?<\/h3><ol><li><p><strong>Liability risks:<\/strong> If damage is caused by incorrect AI use, this could be considered a breach of the employer&#8217;s general duty of care &#8211; especially if no appropriate training can be demonstrated.<\/p><\/li><li><p><strong>Indirect sanctions:<\/strong> Non-cooperation with supervisory authorities or a lack of evidence could have indirect consequences (Art. 99 para. 5 AI Regulation).<\/p><\/li><li><p><strong>Reputational damage:<\/strong> Companies that fail to meet their compliance obligations risk losing the trust of customers and business partners.<\/p><\/li><li><p><strong>Competitive disadvantages:<\/strong> Particularly in public tenders, a lack of compliance can lead to exclusion.<\/p><\/li><\/ol><h3>Important classification<\/h3><p>The training obligation is formulated as a <strong>best practice requirement<\/strong> (&#8220;to the best of our ability&#8221;). The EU Commission confirmed on February 20, 2025 that there is <strong>no certification requirement<\/strong>. Companies therefore have <strong>room for maneuver<\/strong> when it comes to implementation.
